This complaint has been filed by the complainant praying to direct the opposite parties to return the price of the vehicle in question which has been paid to the opposite party no. 2 vide annexure – 1. Besides the aforesaid prayer, a prayer for compensation as well as litigation has also been made in the complaint petition.

This complaint has been filed on 06.07.2013 and admitted on 12.07.2013. it appears from the record that on 09.10.2015 a representative of opposite party no. 1 and 2 Amit Rai appeared and has stated that if the vehicle in question is brought in the service center by the complainant then company will extend service as per terms of the warranty and the complainant will be able to take the vehicle from the service center after one month.

It appears that several adjournments were given to the complainant for taking the vehicle in the service center in order to repair the vehicle in question if needed as per terms of warranty.

On 12.01.2018 last time was given to the complainant for taking action in this case. Today on 21.05.2018 the counsel for the opposite party has stated categorically that up till now the complainant has not brought his motorcycle in question for repair as per direction of this forum dated 09.10.2015. The aforesaid fact clearly proves that the complainant is not interested in complying the order of this forum or intimate this forum about the compliance of this forum order referred above.

In view of the fact this case stands dismissed for non – compliance of order of this forum dated 09.10.2015.
