ORDER BY HON’BLE PRESIDENT- MR. P.K. PADHI:

 

                                                                                           JUDGMENT

            Complainant has filed this consumer complaint U/s.12 of C.P. Act, 1986 seeking following reliefs;

            “Direct the opposite parties for exempt the penal amount and repo charge Rs.5,000/- from his loan account and released the vehicle from custody  and receive actual amount. And pay Rs.10,000/- towards mental agony, Rs.5,000/- towards cost of litigation”.

 

            The brief fact of the case is that, the complainant has purchased a Glamour Motor Cycle bearing Regd. No.OD-21-C-5429 from Trisul Automobile, Jagatsinghpur being financed by opposite parties for an amount of Rs.41,690/- and fixed 24 EMIs for recovery his loan amount from complainant and complainant repaid the said loan amount regularly. In the mean time after receiving total 18 installments of EMIs and within other 6 installments was credit over the complainant, the opposite parties illegally imposed penal amount of Rs.7,628/- for OEI OIS and sum of Rs.11,981/- amount for OBC OIS and Rs.5,000/- demand for deepu charge, try to forcible collect from complainant.   

            Notice to opposite parties was sent by Regd. Post on 12.3.2019. Opposite parties though appeared did not file any written version in spite of repeated adjournments. Admittedly there is some default in paying the installments by the complainant. There are also many defaults in paying the installments in time for which there is huge OD charges.

            Taking into consideration the fact, we direct the opposite parties to charge only 40% of OD charges and allow 3 months time to the complainant to pay the pending EMI along with 40% of OD charges. If the complainant fails to repay the loan within the time given above and carry out the order then opposite parties are free to take action as per law. With the aforesaid observation and direction the consumer complaint is disposed of. No cost.
