Shri Bhagwan filed a consumer case on 22 Nov 2023 against Branch Manager, HDFC Bank Limited in the Fatehabad Consumer Court. The case no is CC/272/2023 and the judgment uploaded on 04 Dec 2023.

ORDER
Heard on the point of maintainability of the complaint.

The present case is related to crop insurance under PMFBY and the complainant was having his account NO.50200011158330 (Kisan Gold Card) with OP No.1; that an amount of Rs.4337.85 was debited from the account of the complainant for the Rabi Crops of 2017 and further an amount of Rs.7062.60 was also debited from the account of the complainant for Kharif Crops-2018 which was further credited in the account of the complainant on 10.08.2018; that further amounts of Rs.7437.68, Rs4517.10/- , Rs.8031.83 and Rs.12,721.27 were debited from the account of the complainant as insurance premium for the crops Rabi-Khariff upto 31.07.2022 ; that the crop of the complainant was damaged and the intimation to the Ops No.2 & 3 was given with a request to make the loss good; that thereafter the complainant and his son were taken by surprise on knowing that the insurance policy for insuring the crops of Rabi-Kharif for the years 2019, 20120 and 2022 was never issued. In the end prayer for compensation of Rs.15,00,000/- alongwith any other relief, which this Commission deems fit, has also been made.

Perusal of the case file reveals that the complainant has made four respondents/Ops, all are related to HDFC Bank Limited, in the present complaint with the prime allegations qua not issuance of insurance policy under PMFBY scheme despite debiting the insurance premiums for insuring Rabi-Khariff crops upto 2022. It is pertinent to mention here that the issue with regard to year 2019 and 2020 is time barred being not taken up within the stipulated period of two years.

After hearing learned counsel for the complainant and going through the material as well as the contents mentioned in the application, this Commission is of the considered opinion in order to reach at any conclusion as well as proper adjudication of the complaint, impleadment of insurance company and concerned Department is necessary. In whole contentions the complainant has levelled allegations against Ops No.1 to 3 but it appears that Ops No.2 & 3 are directly related to Op No.1 and even their address is also same, therefore, it seems that Ops No.2 & 3 are impleaded in the present case unnecessarily, which should have been avoided.
