ORDER

                                                                                                  JUDGMENT

 

            Complainant has filed this consumer complaint U/s.35 of Consumer Protection act, 2019 seeking following reliefs; complainant case in short is that her husband took a policy under PMSBY Policy No.3336/56190621/00/000 and in respect of the policy, complainant’s deceased husband has paid his premium regularly in bank A/c No.4017010003672 and met with an accident on 24.12.2016 during the currency of policy.

            It is admitted fact that there was delay in submitting the claim after 226 days of the death of deceased policy holder for which there was delay in settling the matter. The opposite party No.2 on receipt of notice from this Commission on dt.30.3.2022 replied vide letter dt.04.5.2022 that the claim has already been settled and deposited in Indian Bank, A/c No.6871592853.

            The counsel for complainant is regularly absent after admission except on dt.30.6.2022 on which date he has filed the Xerox copy of front page and last page of the pass book from dt.31.12.2021 to 23.6.2022, whereas from the letter it is revealed that the amount in question has been credited on 27.10.2021 but the complainant has cunningly not filed the page dt.27.10.2021 of the bank pass book with oblique motive. From the last page of pass book the balance available on 31.12.2021 was Rs.3,05,828/- and last balance on 23.6.2022 was Rs.2,40,847/-.

            Complainant under the impression that policy amount has not been paid has filed the case on 04.02.2022 seeking the relief stated as above without checking/updating her pass book. Since the counsel for complainant is absent and nobody appearing for opposite parties except the letter dt.04.5.2022. We are handicapped to get any assistance from both the parties.

            In view of the fact that matter has been settled and complainant has not appeared to state that as to how there is deficiency of service when the matter has been settled and more particularly for not filing the relevant page of the pass book of dt.27.10.2021, we do not impose any compensation and cost. Since the claim amount has been credited and not disclosed by the complainant as per letter dt.04.5.2022, we direct to close the chapter and dispose of case as settled between the parties and has become infrutuous. With the aforesaid observation the consumer complaint is disposed of without any cost.

            Pronounced in the open Commission on this 30th August, 2022.
