SRI DIPAK KUMAR MAHAPATRA,PRESIDENT:-The brief facts of the case is that, the Petitioner is a permanent resident of Village- Bhaliadihi, PO-Tentelabahal, P.S-Reamal of Deogarh District O.P is the Branch Manager of the Co-operative Agriculture & Rural Dev. Bank Ltd., Deogarh.
The complainant had deposited a sum of Rs. 6,000/- on Dtd.19.11.2003 in a fixed deposit scheme in the O.P Bank for a term of 8 ½ year which was matured on May, 2012. After maturity period the complainant proceeded to the O.P Bank and requested to release of his maturity amount but O.Ps remained silent and did not pay the maturity amount. After few months had been passed, the petitioner again visited the O.P Bank and further requested to release his maturity amount but O.P did not take any step. So being aggrieved on the service of the Opp.Parties the complainant filed the complaint petition before this forum.
The O.Ps are set exparte here, as they did not appear on the day of hearing of this case.
From the above discussion it can be inferred that the complainant had deposited a sum of Rs.6,000/- with the Bank O.P. and after maturity period he had been to the Bank of O.P to encash the maturity amount. But the O.P failed to release the amount but harassed the complainant every time. Being aggrieved on this matter the complainant has filed the complaint petition and prayed for certain relief.
So it is clear that the O.Ps have harassed him various way by not releasing the maturity amount which the complainant deserves it. Hence the O.Ps have committed deficiency in service U/S-2(1) (g) of C.P. Act 1986 and liable for penalty.
ORDER
The Complaint petition is allowed in favour of the complainant and the O.Ps are jointly and severally here by directed to pay the maturity amount of Rs.12,000/- (Rupees twelve thousand) and pay interest on the maturity amount at the rate prevailing time to time from the date of maturity till the actual date of payment to the complainant . Further the Opp.Parties are directed Rs.7,000 (Rupees Seven Thousand )only as compensation ,Rs.3.000 (Rupees three thousand ) for mental agony of the petitioner. The O.P is further directed to comply the order within 30 (Thirty ) days of receipt of this order failing which the O.P is liable to pay penal interest of 12% per annum on the above amounts .
Office is directed to supply the free copies of the order to the parties receiving acknowledgement of the delivery of thereof.
