ORDER

Complainant physically present. OP represented through his advocate. Heard the complainant and learned advocate for the OP in full and peruse the record. In has been submitted by the learned advocate for the OP that the insured vehicle which was claim to have been stollen for which piro(Bhojpuri) police station case no-432 of 2021 dated 26.11.2021 under section 379 IPC was registered and corresponding compensation through payment of insured money was claimed to which the present complaint case relates has been found recovered and seized for carrying litre liquor in violation of the provision of carrying liquours in the state of Bihar as per the provisions of Bihar and odisha exise Act for which Rafiganj (Aurangabad) PS case no 13/2023 has been registered under section 30(A)36 Bihar provisions of liquours and amendent excise Act 2018.

Learned advocate for the OP has annexed the FIR of the above referred Rafiganj(Aurangabad) PS Case no-13/2023 and the enquiry report of the investiget office.

Since, the alleged stollen motorcycle has recovered claim of the complainant alleging theft of the insured motorcycle has became infractual hence the present complaint is dismissed and the complainant is directed to take appropriate of cour of law for release of his allegely stollen vehicle.
