                Complt files hazira through Ld Advocate. O.Ps also file hazira through Ld Advocate.

                The petition filed by O.Ps praying for vacating the order for hearing the case exparte is taken up.

                Perused the petition and other materials on record. Heard both sides. The Complt. raised  no-objection.

                In the said petition O.Ps  have prayed for vacating the order for hearing the case exparte.

                From the record it is found that the O.Ps appeared before the Forum in time, but they failed to submit W.V. within the statutory period.  As such, the case was fixed for hearing the case exparte. The O.Ps  have filed W.V. which shows their intention to contest the case. So, they must get an opportunity to contest the case. However, they must pay cost as penalty for causing delay. The petition accordingly considered and allowed.

                That the Miscellaneous Application No.MA/ 01/2023 be and the same is allowed on contest with a cost of Rs.500/- to be paid to the complainant by O.Ps. The order for hearing the case exparte is hereby vacated. The W.V. filed by O.Ps. will be accepted only after payment of cost.

The Case is thus disposed of.
