FINAL ORDER / JUDGEMENT

The record is taken up for delivery of judgement.
The Complainant’s case is that he got house building loan sanctioned from the O.P. Bank on 28-12-2006 for Rs.3,25,000/- repayable by 114 EMI @ Rs.4,165/- with interest by deposit of collateral security like KVPS etc, and has regularly paid EMI as per loan agreement. At the end of the loan transaction when the prayer was made for completion of loan payment with issuance of Clearance Certificate by releasing all the collateral security the Complainant detected in the loan account that a sum of Rs.39,448/- is still due, payable to the O.P. Finding no relief from the Bank authority the Complainant has approached this Commission for appropriate relief.
The O.P. Bank authority contested the case by submitting written version denying all the material allegations made in the complaint.
Having regard to the submission, contention and supporting documents placed before the Commission it reveals that the loan account of the Complainant has not yet been finalized subject to payment of Rs.39,448/-. The O.P. could not justify the excess deduction of Rs.39,448/- from the loan account of the Complainant but the documents placed before the Commission on behalf of the Complainant lend support to the complaint case.

Accordingly the case succeeds.
Hence it is ordered…….
That the case be and the same is allowed on contest against the O.P.
The O.P. is directed to return to the Complainant Rs.39,448/- as excess deduction from SB account No.2311981112 of the Complainant with further direction to issue no dues certificate after releasing all the collateral security within one month from this date failing which the order may be enforced in due process of law.
Both parties be supplied copy of the order free of cost.
