Ordered

That the case be and the same is allowed on contest against the OP1 and same is allowed ex parte against OP2 with a cost of Rs.3,000/-.

          OPs are jointly and severally directed to pay a compensation of Rs.5,000/- to the complainant for causing harassment to the complainant in deficient manner and also to show their negative attitude and disputes also for adopting a deceitful manner of trade in this regard and further for dereliction of the duty on the part of the OP Bank. 

          OPs are jointly and severally hereby directed to pay compensation of Rs.5,000/- and also litigation cost of Rs.3,000/- i.e. total Rs.8,000/- to the complainant within one month from the date of this order failing which penal damages  at the rateRs.100/- shall be paid by the OPs jointly and severally till full satisfaction of the decree even if it is found that OPs are reluctant to comply the order in that case penal proceeding shall be started against them u/s.25 read with Section 27 of the C.P. Act for which further penalty and fine shall be imposed.
