Smt. Jigeesha Mishra, President : - This is the case of complainant alleging deficiency in service against the O.Ps.
The case of the complainant is that the complainant has taken housing loan of Rs.8,00,000/- ( Rupees eight lakhs) only from bank of India,Jharsuguda branch/O.P No.1. The complainant has deposited the original Record of Roght in security bearing R.O.R Khata No. 747/3736, Plot No. 3732/10629. Area A.C. 0.038 dcs of Mouza,Jharsuguda town Unit-2 Balijori and registered sale deed No. 1086 1203 342. The complainant has cleared up all the loan dues and the loan account has been closed from dt.12.08.2019 but the O.P.No. has not get returned the original Patta to the complainant, hence this case.
2. Notice served through registered post by this commission but the O.ps neither appear nor filed their written version since long. Hence all the O.ps are set ex-parte.
3. Perused the records and it reveals that in the letter No. 2/11/2019 the senior branch manager has admitted that the original Patta has been misplaced. So it is purely a case of deficiency in service on the part of the O.ps.Several correspondence were made but the O.Ps failed to return the original documents to the complainant nor contested the case.
Accordingly it is ordered:-
ORDER
The complaint is allowed ex-parte against Opposite parties. The O.ps are deficient in their service, accordingly the O.Ps. are directed to return the original R.O.R bearing Nio.747/3736 of Mauza Jharsuguda Town Unit-2 within 30 days from the date of this order to the complainant. In case of non-compliance the O.Ps are to pay Rs.8,00,000/- (eight lakhs only) to the complainant with 12% interest per annum from the date of closure of loan Account No. 557075 110 000050 i.e. from 12.08.2019. Further the O.ps. are directed to pay compensation of Rs.50,000/- ( Rupees fifty thousand) only for harassment and mental agony along with Rs.5,000/- (Rupees five thousand) only towards litigation expenses to the complainant.
Accordingly the case is disposed of.
