Record is put up today in view of petition filed by Jdr. through his advocate.

Jdr. files another petition through his advocate along with A/c payee cheque and prays for permission to deposit an A/c Payee cheque bearing no.172033 dated 05-05-2016 amounting to Rs.63,500/- (Sixty three thousand and Five hundred) drawn on Axis Bank Ltd. in favour of Sri Dipankar Samanta Dhr. with a copy to other side Dhr.

Ld. Advocate for Dhr. is present by filing his hazira.

Heard both sides.  Perused the petition and materials on record.

It appears from the record as well as copy of the Judgement dated 26-08-2015 passed by the Hon’ble State Commission in F.A. no.731 of 2013 that Hon’ble State Commission has made direction interalia “The Appellant is directed to make payment of the amount awarded by the Ld. District Consumer Disputes Redressal Forum, Bankura within one month from the date of this order failing which the Respondent being Complainant of the case shall have the liberty to execute order in accordance with law.

The interim order, as passed hereinbefore, stands vacated.”

So, Ld. Advocate for the Jdr. submitted before us interalia that Jdr. files this petition and prays for permission to deposit said A/c payee cheque in this Forum as per direction made by the Hon’ble State Commission in F.A. no. 731 of 2013.

Considering the above facts & circumstances Jdr. is hereby permitted to deposit the said A/c payee cheque no.172033 dated 05-05-2016 amounting to Rs.63,500/- (Sixty three thousand and Five hundred) drawn on Axis Bank Ltd. in favour of Sri Dipankar Samanta Dhr.  Registrar-in-charge to receive the said cheque and to keep the same in safe custody.

A photocopy kept of the said cheque be also kept with this record.
