Hazira is filed on behalf of the Complainant through Advocate.
Step is taken on behalf of the O.P. through lawyer praying for adjournment on lawyer’s ground. Ld. Advocate appearing for the O.P. did not press the adjournment petition but argued the case.
Ld. Advocate for the complainant also advanced his argument.
After hearing arguments from both sides the Commission proceeds to dispose of the case hereunder.
The complainant’s case is that he has a Savings Bank Account No. 913010048078351with O.P./Bank and took loan of Rs.28,000/- which was duly repaid with interest on 29-12-2018 but thereafter the complainant found deduction in the said Savings Bank A/c viz Rs.6,477.78 on 03-10-2019, Rs.1,566 on 14-10-2019, Rs.2,889 on 16-01-2020, Rs.3,849.07 on 01-02-2020 & Rs.1,300.89 on 02-04-2020 totalling Rs.16,082.74. Finding no source of such deduction the complainant has approached this Commission for appropriate relief.

The O.P./Bank contested the case by filing written version contending inter alia that Credit Card has been issued in favour of the complainant and by using the said Credit card No. 530562******6900 the complainant entered into several transactions with different Authorities such as JSK Refilling Centre, Bankura, payment of EMI interest, Sevak Fuel Centre, Durgapur, JIO Money etc. and all the above mentioned deductions arises out of those transactions and in support of those transactions Bank statement in whole has been produced at the time of hearing as part of written version. The complainant could not but admit the same as he could not produce any documentary evidence to negate those transactions.
It seems to the Commission that the complainant might be unaware of those transactions and possession of Credit card issued by the O.P./Bank for reasons best known to him. On examination of all the materials on record the Commission finds that all the deductions are justified and the complainant cannot raise any claim from the O.P. on that score. Ld. Advocate appearing for the complainant has urged the Commission to pass necessary order for any unwarranted deduction in future.
Thus the complainant has no case to succeed against the O.P.
Hence it is ordered……..
That the instant case is dismissed on contest but without cost with direction upon the O.P. to give due message to the complainant whenever such deductions through Credit Card are made.
Copy of this Order be supplied to both parties free of cost.
