This case has been filed by the complainant U/S 12 of C P Act’1986, praying for payment of an amount of Rs. 1000/- only, which was awarded, to her, as incentive, as per Govt. policy and compensation of Rs. 10,000/- for mental pain and agony, faced.
The case of the complainant, in brief, is that, the complainant, gave birth to a male child in Shaktipur BPHC and was released from the Health Centre, on 09-06- 2016 and was awarded with a cheque of Rs. 1000/-, as incentive, as per Govt. policy, which, she deposited, to Allahabad Bank, Jhunka Branch, (OP), for crediting, on her a/c., kept with that bank / OP, on 13. 06. 2016.
Thereafter, the OP, denied, crediting the cheque in complainant’s a/c, which compelled the OP, to lodge a complaint, to the department of Consumer Affairs & Fair Business Practices, Murshidabad Regional office at Berhampore, who issued a notice to OP, for honoring the cheque, but the OP, did not credit the cheque, in complainant’s a/c, even then.
Hence, the instant complaint was lodged before this Forum.
The W/V filed by the OP, stated that that the complainant is not maintainable in its present form, alongwith, some other observations.
The OP, further stated that the cheque could not be honored, as it was misplaced, at their end. Again, the OP stated that the cheque could not be credited as; there had been some defect, in the cheque, initiated by the issuing authority.
All of the parties had recorded their presence, in the matter, when the matter was referred to this Forum, for adjudication and submitted documents, in support of their submission (s).
Both the parties argued the matter.
Subsequently, both the parties, agreed to settle the matter, on contest.

- Whether the complainant is entitled to get relief, as prayed for.
Decisions with reasons
To prove the case, the complainant, has filed copies of relevant documents, along with evidence – in –chief, in support of his complaint. The OP has also filed W/V.
Hence,
ORDERED
- he Consumer Complaint no. 46/2017 is allowed in part.
OP is directed to pay an amount Rs. 1000/- to the complainant, towards, crediting of the amount, awarded to the complainant, as incentive and to pay, another amount of Rs. 2000/-, towards, the harassment, faced by the complainant, along with litigation cost, within 30 days, from the date of receipt of this order, in default, the Op (s), will have to pay an amount of Rs. 50/-, per day’s delay and the amount, so accumulated, shall be deposited to Consumer legal Aid account.
Let a copy of this order be made available and be supplied free of cost to each of the parties, on contest, by hand, under proper acknowledgement / be sent, forthwith, under ordinary post, to the concerned parties, as per rules, for information and necessary action.
