Today is fixed for hearing of the petition filed by Dhr. on 30-04-2019 and E.R. of W.A.

None appear on behalf of the Jdr. Ld. Advocates of Local Bar Association are observing cease work since 13/08/2018. Under such circumstances Dhr. filed a petition on 30-04-2019 for withdrawal of the case. Heard, considered and allowed the petition.

It also appears from the record that W.A. upon the O.P.No.-1 has not been issued as the notice upon O.P.No.-1 has not been served since the office of O.P.No.-1 has been closed since long time. Hence the order for E.R. has been written inadvertently. Accordingly, we have no impediment to dismiss the case as per the prayer of Dhr.

Hence, it is

ORDERED

That E.A. No.07/2017 be and the same is dismissed for non prosecution without cost.

Let a plain copy of this order be supplied to parties each free of cost.
