Today is fixed for argument. The complainant filed one application supported by an affidavit U/s 12(c) of the C.P. Act. O.P. No.2 has prayed for time. We have perused that the dispute is with the educational institution. It may be mentioned here that Hon’ble National Commission while disposing the Revision Petition No.4620 of 2012, have observed the view of the Hon’ble Supreme Court in Revision Petition No. 605/2012. So, we find that “in view of the judgment of this Court in Maharshi Dayanand University Vs. Surjeet Kaour 2010(II) SSC page-159, wherein Hon’ble National Commission placed reliance from earlier judgment and has categorically held that education is not a commodity. Educational Institution are not providing any kind of service, therefore, in matter of admission, fees, etc., there cannot be a question of deficiency of service, such matter cannot be entertained by the Consumer Forum under the C.P. Act, 1986. This observation of the Hon’ble Commission have communicated before us by the Hon’ble State Commission on 11.11.2014. So, we are not inclined to pass any order whatsoever except that this Forum has no jurisdiction to entertain the matter under the head of C.P. Act, 1986.
In view of the back drop, it is
ORDERED
that the application U/ 12 of the C.P. Act, is dismissed on the light of the observation made in above without going into the merit of the case. Let the plain copy of this order be handed over all the parties free of cost.
