Both sides are absent on calls. Today is fixed for filing show cause by the Complainant/ Decree holder as to why the case shall not be dismissed due to non prosecution. But no show cause filed by the complainant/ Decree holder today. It appears from the case record that since 4.1.2019 the case is pending for s/r & app. But the Dhr neither appeared in persion nor by its agent and no requisites and no requisites filed till date so this forum vide its order dated 06.11.2019 directed the Decree Holder to file show cause as to why the execution case shall not be dismissed due to non prosecution. That on 7.1.2020 the Complainant/ decree holder is absent on calls and no steps taken on her behalf and no show cause filed till today.

 So this Forum may presume that the complainant/ decree holders are not interested to proceed with the case further. As such the Execution case being no 53 of 2018 is deserved to be dismissed due to nonprosecution.

Hence ordered that the Execution case being number 53 of 2018 be and the same is dismissed due to nonprosecution.
