(The matter has been heard through virtual hearing).
2. Mr. Tanmoy Gupta, counsel for the Decree Holder-complainant states that he has got the copy of the order passed by the Hon’ble National Consumer Commission, New Delhi from Mr. Hemant Saini, counsel for the Judgment Debtor-opposite party.
3. Mr. Tanmoy Gupta, counsel for the Decree Holder-complainant also made a statement at the Bar that he will file a fresh execution application. He also states that he does not want to pursue the present execution application and wants to withdraw the same with the liberty to file a fresh one. He would file it again after the decision of the Hon’ble National Consumer Commission, New Delhi in Appeal No.697 of 2021 and Appeal No.698 of 2021.
4 On the other hand, Mr. Hemant Saini, counsel for the Judgment Debtor-opposite party has no objection to the same.
5. In view of the statement made by Mr. Tanmoy Gupta, counsel for the Decree Holder-complainant, the present the execution application is hereby dismissed as withdrawn with the liberty to file a fresh one. File be consigned to the record room.
