Opposite party No. 2 exparte.

Sh. Shiv Darshan Bansal Advocate has filed power of attorney alongwith written arguments on behalf of opposite party No. 1. Complainant stated that he has no objection if the opposite party No. 1 is ready to replace the body of washing machine in question and rectify the other defects free of costs. On this, the Ld. Counsel for opposite party No. 1 stated at bar that the opposite party No. 1 (company) is ready to replace the body of washing machine in question and also ready to rectify the other defects of washing machine free of costs. 

We have gone through the facts of complaint and oral submissions made by the parties. The complainant in his complaint has alleged that he has purchased the above said washing machine on 30.6.2017 for consideration of Rs. 24,000/- and the machine is having 5 years of guarantee. We have also gone through the photographs of above said washing machine placed on record by the complainant, from which it has been shows that the above said washine machine developed defects in its body as the same started getting rusted. So, keeping in view the facts and circumstances of the present case, we are of the view that if a direction is issued to the opposite party No. 1 to replace the body of above said washing machine and rectify/repair the other defects of washing machine that will suffice the purpose of the complainant. Accordingly, the present complaint is disposed of with a direction to the opposite party No. 1 to replace the body of washing machine in question. The opposite party No. 1 is further directed to rectify/repair the other defects of washing machine free of costs. However, there is no order to costs or compensation. Copy of the order be supplied to the parties free of costs. File be consigned to records after its due compliance.
