Statement of counsel for OP N.3 has been recorded to the effect that the complainant has already deposited the mobile set with care centre of the manufacturing company i.e opposite party No.2. The company (opposite party No.3) is ready to refund the purchase price of mobile to complainant within 45 days from today.

Statement of counsel for complainant has also been recorded to the effect that he has heard the statement which is suffered by counsel for OP No.3. He agrees with the above said statement suffered by counsel for OP No.3. As per instruction of his client (complainant), he withdraws the present complaint.

In view of the statements suffered by the counsels for the parties, the present complaint is dismissed as withdrawn. Parties will be bound by their statements. File be indexed and consigned to record.
