This case was fixed for orders today but learned counsel of complainant and opposite party no. 2 along with the complainant appear before us and submits that they are ready for a compromise and as such they have prayed that orders in this regard may be passed. The learned counsel for the opposite party submits that he was ready from before and still ready to refund the price of the Saree provided the complainant returns the old Saree. On the other hand the learned counsel for the complainant submits that he is ready to accept the proposal of the opposite party but prays the forum that the complainant may be awarded the litigation costs. Heard both the parties. Accordingly, We direct the opposite party no. 2 to refund Rs. 515/- ( Rs. Five Hundred Fifteen only ), being the price of the Saree, within a period of two months from the date of receipt of this order failing which an interest @ 6% per annum will be paid on the aforesaid amount till final payment is made. Prior to receiving the payment the complainant will have to return the old Saree to the opposite party no. 2. Since the opposite party no. 2 was ready from very beginning to refund the price of the Saree and due to non acceptance of this proposal at that time by the complainant, the matter could not be settled and thus delay which has occurred in the matter is due to complainant and taking into account this stands of the opposite party we are not inclined to give any costs to the complainant.
