ORDER

Parveen Gupta vs. Boby Melody Palace etc.

CC No. 62 of 2016.

 

Present: Ms. Sonia Rohilla, Advocate, counsel for complainant.   

              Sh. Sumit Gupta, Advocate, counsel for OPs No.2 to 4.

 

                        Today the case was fixed for evidence of complainant. However, counsel for the OPs No.2 to 4 made a statement that they are ready to pay an amount of Rs. 4500/- out of bill amount of Rs. 6000/- after deducting depreciation to the complainant subject to deposition of the old mobile set (without broken and water logged) alongwith accessories by the complainant and made the payment within 30 days.

                        On the other hand, counsel for the complainant made a statement that in view of the aforesaid statement of OPs No.2 to 4, she does not want to pursue the present complaint, which may be filed.

                        Heard. The proposal made by the counsel for the OPs No.2 to 4 for an amount of Rs.4500/-, subject to deposition of old mobile set alongwith accessories, has been accepted by the counsel for the complainant. Hence, we partly allow the complaint of complainant and OPs No.2 to 4 are hereby directed to make the payment of Rs. 4500/- to the complainant, subject to deposit of old mobile set alongwith accessories, within a period of 30 days failing which the OPs No.2 to 4 shall also liable to pay interest at the rate of 9% per annum for the defaulting period. Both the parties shall remain bound by their respective statement recorded separately. Copy of this order be sent to the parties concerned free of costs as per rules. File be consigned to the record room after due compliance.
