Complainant Debasish Nath is absent.

Mr. H. R. Obing, l’d counsel for the SBI appeared and filed written argument and prayed for dismissal of the case. Mr. Obing also prayed for imposing fine upon the complainant as complainant is unnecessarily consumed the precious time of the bank as well as this Commission without any cause of action. After institution of the case, there have been six consecutive hearings. It is found that l’d counsel had travel from Itanagar to Yupia covering 42 KM (to & fro).

In view of the above, this Commission is of the considered view that imposing a fine of Rs.5,000/-(Five Thousand) only upon the complainant meets ends of justice. Hence, Mr. Debasish Nath is directed to pay Rs.5,000/- to the sole respondent in cash/cheque or through digital mode within 15 days from receipt of copy of this order.

Considering the application dated 24.03.2023 filed by the complainant and prayer of Mr. Obing, application stands dismissed on being withdrawn.
