The D.Hr’s counsel is present. None appears for the D.Hr on repeated calls.

            The D.Hr has filed a petition on dtd. 24/1/2017 with a prayer to consider his petition dtd 08/09/2016. Both the above said petitions(memos) have been filed to drop the case as the main C.C. case has been disposed of as per direction by the Hon’ble State Commission. Both the memos have been served on the D.Hr’s counsel who has received the copy without any objection. Despite adjournment, the D.Hr’s counsel did not appear in person. So heard from the J.Dr’s counsel.

                Perused the record.

               The main C.C. Case No-77/2013 has been disposed of by the this forum on dtd 14/10/2016 as per direction of the Hon’ble State Commission. Since the main case has been disposed of (dismissed). This execution case is automatically infructuous. Further the D.Hr’s counsel has no objection if the case is dropped. So the case is disposed of (dropped) without any cost.
