                         1. The complainant has filed the instant case against the opposite party for deficiency in service for not providing damage for his insured vehicle by the Opposite Party and demanded ₹20,

 

                                          (2)        Case No.-115-2012

 

 

                          2. In brief, fact of the case that the complainant got insurance for his Maruti car, registration number JH 05 J / party. Policy No.was /31/8/

                                    3. The Opposite Party appeared and filed his Written Statement listening there in that allegations made by the complainant are not true. The claim of the complainant was received and Licensee Seryoyer Mr Satish Kumar was deputed who submitted his report on 30 November

 complainant did not co-operate. The Opposite Party is ready to pay ₹ 3,

                              4. Both parties have submitted their evidences on Affidavits and documents.

                               5. Here the question for determination is which bill for the damaged vehicle was correct and weather there was any deficiency in service on the part of opposite party and weather the complainant is entitled to get the relief as sought for.

                                6. It is admitted facts that the vehicle in question was damaged and it was repaired. There is surveyor report of Satish Kumar as Annexure 1 on the case record for ₹ Case No.-115-2012

 

                                7. Considering the fact of the case,  Evidence on Affidavit of both parties and documents filed by them we arrive on the conclusion that there is deficiency in service on the part of opposite parties and the complainant is entitled to get repair cost ₹20,expenses.
