Shri S. L. Behera, President: - The brief facts of the complainant’s case is that, he has purchased one Ten wheeler Truck bearing Regn. No.OR-23E-2599 which has been financed by the O.Ps for an amount of Rs.14,34,000/- only which extended to Rs.20,23,032/- only with interest and insurance. The complainant was liable to pay the loan amount in 47 installments @ Rs.43,000/- only per month started from dtd. 02.05.2011 to 02.03.2015. The complainant has paid Rs.15,12,895/- only and cleared 36 nos. of EMIs. but the account statement issued by the O.Ps. showing amount of Rs.14,79,800/- only and without any clarification the O.Ps. threatening to seize the vehicle, hence this case.

The O.Ps. appeared through his counsel after being noticed and submitted his written version wherein it has been stated that the complainant is a defaulter in making payments of installments.  The O.Ps. submitted that the complainant has outstanding dues of RS.2,60,202/- only towards installments and Rs.1,16,788/- only towards overdue charges.  The O.Ps admitted that they have received Rs.14,79,800/- only till dated 30.08.2014 and the difference amount of Rs.37,095/- only has been adjusted for various charges as per terms and conditions of the agreement with denying all the allegations imposed by the complainant, the O.Ps  prayed for dismissal of the case.

Heard and perused the case record along with materials available.

 As per the repayment schedule the loan started from dtd. 02.05.2011 to 02.03.2015.  The 1st installment was Rs.45,032/- only and the rest 46 nos. of installments were Rs.43,000/- only per month.  As per the statement of account filed by the O.Ps dtd. 15.03.2015 the O.Ps have received Rs.17,62,830/- only and due till date Rs.2,23,032/- only , Overdue installment Rs.2,60,202/- only and Accrued ODC Rs.1,16,788/- only.

The O.Ps. have sanctioned loan facility to the complainant to purchase the vehicle, against which the complainant should also repay the same in time but sometimes he fails to do so.  However, the O.Ps. complied the Interim Order passed by this Hon’ble Forum and now the said vehicle is in possession of the complainant which the complainant must repay the outstanding dues in time.

In view of above circumstances, we do not found any merit on the part of complainant, hence we dismiss the case with no costs.

            Accordingly the case is disposed of.
