Petition dated 09/08/2023 filed by O.P No. 1 and 2 is taken up for hearing. Said petition is registered as M.A. case no. 187/2023. Complainant files W/O.
Said petition is taken up for hearing. Heard both sides. Perused the petition. Also perused the W/O. On perusal of petition of complaint we find that Complainant in para no. 14 has mentioned that patient namely Manjila Bibi is bed ridden. Present Complainant being the father-in-law of said Manjila Bibi filed this case.
During hearing Ld. Advocate for the O.P No. 1 and 2 submits that father-in-law has no right to lodge complaint on behalf of daughter-in-law. On perusal of treatment papers we find that present Complainant namely Zinnah Ali put signature in the treatment papers, also put signature in the consent letter and other documents.
Considering the entire matter we think that present Complainant should be permitted to continue the case on behalf of his daughter-in-law namely Manjila Bibi. Accordingly we find that present case is maintainable.
In view of aforesaid discussion we find that aforesaid petition dated 09/08/2023 filed by the O.P No. 1 and 2 is devoid of merits and same is rejected but without any order as to cost.
Aforesaid M.A case vide no. 187/2023 is thus disposed of.
