             The petitioner/Complainant files hajira. The case is taken up for admission hearing. The fact of the case in brief is that the complainant is a consumer of the O.P.2 and 3/AXIS BANK LTD. He had a debit card bearing no. 4179170002270153. The validity of the said card expired in the month of October 2016. Subsequently the O.P.2 issued one fresh debit card through the O.P.no.1/Blue Dart. But unfortunately the said debit card was not delivered to the complainant in time. As a result the card has been blocked and couldn’t be operated causing much harassment to the complainant due to the deliberate negligence on the part of the O.Ps. This is a clear case of Deficiency in Service. Accordingly the complainant has filed the present case praying for reliefs from the O.Ps. as per prayer of the complaint petition. .

             The complainant fairly submitted before us that he received one sealed envelope containing the fresh debit card. He has also admitted before us that he didn’t open the said sealed envelope and used the debit card to know as to whether the same has been actually blocked or not. Therefore in our opinion the complainant has nothing to show that the fresh debit card received by him has been blocked and it is inoperative. Accordingly we hold that there is no cause of action to file the present case . As such the case cannot be admitted and is liable to be dismissed. Hence it is

O R D E R E D

             that the CC no. 12/2017 be and the same is dismissed without cost.
