Final Order / Judgement

   The complainant is a beneficiary of Indira Awas Yojana filed this case alleging that he did not get bonus money of Rs.10,000/- (after complete of construction in due time) and money from employment on MGNREGA scheme of Rs.15,000/- amounting to total of Rs.25,000/- from the O.P. due to  negligence of B.D.O Harabhanga and PD, DRDA,Boudh out of IAY scheme provided to him. He has mentioned in his petition that the above money of bonus and money of MGNREGA is orally assured by B.D.O Harabhanga and PD, DRDA Boudh with condition to complete the construction IAY house in right time i.e within three months from the date of work order. Further he has submitted a copy of application that he had given to collector on dtd.06.04.2017 on nonpayment of above mentioned claims.

            The complainant being a beneficiary under Indira Awas Yojaja (IAY) of the year 2014-15 and had got bearing work order no.81 dtd.15.02.2016 of Harabhanga Block in his name, where it is clearly mentioned that he will get Rs.70, 000/- in three phases i.e Rs.15,000/- when  will  receive work orders.45,000/- when he will complete up to  limited label and Rs.10,000./- after  living at home  with complete constructed house with latrine. But it is reveal from his bank statement that the above amounts were credited to his account on dtd.31.01.2026, 20.08.2016 and 17.07.2016 respectively through IAY scheme.

            Whereas O.P.No.1 and 2 have not filed any written version though sufficient opportunities have been given to them.

            However, by examining the merits of the case and evidence provided by the complainant, we came to conclusion that the complainant has received his dues, which was mentioned in work order, but regarding his claims of bonus of MGNREGA, neither he provide any written evidence nor any affidavit in support his claims in the case and he has been continuously absent though repeated notices issued to him.

Hence we dismiss the case of the complainant against the O.Ps without cost.
