The present C.C.Case No. 51/2022 is taken up today for order. The complaint petition filed U/S-35 of C.P.Act, 2019. The Complainant is inhabitant of Kendrapara Block applied for a project “Maschhya Pokhri Yojana” under the Odisha State Govt. Scheme. On his own landed property as per Govt. of Odisha guideline. The Project sanctioned on favour of Complainant by the Ops authorities to a tune of Rs. 2,04,276/- (Rs.Two Lakhs four thousand two hundred seventy six) and issued work order vide letter No. 2157 on dt. 03.06.2020 in favour of Complainants/beneficiary. The authorities(Ops) after injury and majorment of the Pond transferred only Rs. 16,000/- to beneficiary Cuttack Gramya Bank, A/C No. 40230100003392 while spent Rs. 2 Lakhs on the work. The Complainants alleged that the Ops misappropriated rest of the amount without paying to the Complainant.
The Complainant being a poor farmer could not raised the issue before appropriate authorities like Ld. Collector, Kendrapara so also not filed writ petition before Honbl’e High Court to pay litigation expenses. We are being district level quasi judicial body established only to adjudicated issues involving defect, deficiency, unfair contract, unfair trade practice arising between parties. This case involved in different angles where public authorities are the Ops, we have no such jurisdiction to issue mandamus so that the authorities answerable to the notice. Knowing the same the Ops have not filed any written version after notice. It is alleged that the Petitioner suffered financial loss to a tune of Rs. 1,75,000/-. If the Govt. of Odisha scheme not given to needy poor people under such scheme, then we are remain undeveloped due to the inaction of Public authorities. The authority should act for betterment of privileged people. Today human rights have widened peoples rights, therefore the B.D.O and D.F.O-cum-Chief Executive Officer again should hear grievances of Petitioner for a public betterment within one month in a just & proper manner.

It is directed that the Ops/authorities shall make a proper inquiry and redress the grievances of Petitioner on humanitarian ground within period of one month and take a decision at their level to disburse the outstanding amount for interest of justice, failing which the Petitioner may exercise all other remedies available under the law.
On the above observation the C.C.Case is accordingly disposed off.
