          Ld. Advocates for revisionist and respondent no. 1 are present. Ld. Advocate for the respondent no. 1 Bisweswar Pradhan submits that he has no objection if the revision application is allowed.

          Being aggrieved by and dissatisfied with order no. 7 dt. 22.11.2019 passed by DCDRC, South 24 Parganas in CC/119/2019 rejecting the application dt. 07.11.2019 by OP no. 2 praying for expunging the OP no. 2 Netai Chandra Gayen Alias Netai Gayen from the petition of complaint, the Revisionist Netai Chandra Gayen being the OP no. 2 in the case preferred this revision.

          The Ld. Advocate for the complainant / respondent no. 1 submits that the presence of OP no. 2 is immaterial in the complaint case. So, his name be expunged from the complaint petition.

          Hence it is ordered

          The RP/19/2020 is allowed and disposed of on contest. The impugned order is set aside. In consequence the petition dt. 07.11.2019 filed by OP no. 2 is allowed. Let the name of the OP no. 2 be expunged from the cause title of the complaint.

          The parties are directed to appear before the DCDRC below within one month of this order.

          The Ld. Forum below is directed to dispose of the maintainability petition as early as possible after giving both parties an opportunity of being heard.
