Heard the learned counsel for the petitioner. As per his submission the defect is removed in course of day.

2.      Learned counsel for the petitioner submitted that the learned District Forum passed the impugned order on 11.11.22 directing the O.P to release the vehicle subject to payment of one EMI by the complainant within a month. He submits that without giving opportunity and without considering the outstanding of Rs.2,10, 000/- impugned order has been passed the ex parte. So he submitted to set aside the impugned order by allowing the revision.

3.      Considered the submission and perused the impugned order and the revision petition.  

4.      Considering the nature of the case, we do not want to issue notice to the O.P .We also do not want to interfere with the impugned order passed U/S 38(8) of C.P.Act. However, we revise the order by directing the complainant to pay Rs.1,00,000/- (one lakh) within a month to the O.P and immediately after deposit the amount, the vehicle should be released. Further, the learned District Commission is directed to dispose of the  complaint case within a period of 45 days  from the date of receipt of this order.

           The petitioner is directed to appear before the learned District Commission on 23.12.2022 to receive further instruction from it.

           Revision petition is disposed of accordingly.
