Today learned counsel Sh. Deepak Ahluwalia for the appellant, Sh. Bishan Dutt Joshi – respondent No. 1 alongwith his counsel Sh. Manoj Singh Bisht and an associate Sh. Gandharv Matta of senior counsel Sh. Tarun Matta on behalf of respondent No. 2 have appeared.
A compromise (paper No. 110) has already been filed, which was duly verified and accepted by both the parties.
A perusal of the order sheet dated 16.09.2022 and 18.10.2022 has revealed that as per the terms of compromise, the entire decretal amount has been deposited, hence, no dispute remain pending between the parties.
As both the parties accepted the above compromise, hence, the compromise is hereby accepted.
The appeal is decided accordingly in terms of compromise. The compromise shall form part of the decree. No order as to costs.
Statutory amount deposited by the appellant be released in favour of the appellant.
File be consigned to the record room alongwith copy of this order.
A copy of this order be sent to the District Commission concerned for perusal and necessary action and for keeping it in record of the original case.
