ORDER

By  Smt.Padmini Sudheesh, President :

The case of complainant s that on 28/3/08 the complainant invested amount in gold plus policy of 1st respondent.  The complainant issued a cheque drawn on  Catholic Syrian Bank, Mannuthy branch for an amount of Rs.25,000/- and 1st respondent collected the amount from the bank.  It was made to believe that the policy was an investment policy and the amount will be  doubled and  trippled in three years.  The terms and conditions were not  revealed to complainant.  The complainant  remained all these years  believing that his investment would be doubled by this time and is further  accruing.  When the complainant approached 1st respondent for closing the investment plan on 29/7/13 it was informed the complainant need to revive the policy by  paying around Rs.3,00,000/-.  Since the complainant had no intention to further deposit into the wealth plan he  requested to return the money along with the accruals.  But the respondent refused the same.  Hence the complaint.

          2. The respondents remained exparte.

          3. The complainant filed affidavit and Exhibits P1 and P2 documents.  There is no evidence to the contrary.

          4. In the result the complaint is allowed and the respondents are directed to return Rs.25,000/- (Rupees Twenty five thousand only) with 12% interest from 28/3/08 till realization with costs Rs.1,000/- (Rupees One thousand only) within two months from the date of receipt of copy of this order.  Since interest is awarded no separate compensation is seen necessary.

Dictated to the Confidential Assistant, transcribed by her, corrected by me and pronounced in the open Forum this the 31st  day  of July        2014.
