Complainant submits his case. Upon considering his submissions and on perusal of the entire materials on record, it appears that complainant obtained two policies from o.p. and for which he paid Rs.15,001.09 on 7.3.12 for the policy being no.005425447 and paid Rs.15,001.09 on 9.3.12 for the policy being no.005426146. Complainant is the policy owner and the name of the life assured is Master Nilay Singha.
Complainant states that the representative of o.p. approached him in the month of January and February 2013 and stated that if he would pay Rs.40,000/- only then he will not have to pay any more premium in respect of the aforesaid policies. Accordingly, complainant paid Rs.40,000/- and he was astonished by seeing that o.p. has issued another new policy with mediclaim reimbursement benefit and 13.5% interest per annum for the sum assured.
Complainant approached the o.p. to refund the amount for his new policy and accordingly, o.p. has returned Rs.40,000/-.
Complainant has stated that he has not obtained the mediclaim reimbursement benefit from the two policies being nos.005425447 and 005426146. But we find no clause in those two policy papers wherefrom it is evident that o.p. would render such benefit to the complainant.
Complainant has prayed for in the prayer portion of the complaint petition for refund the entire policy amount of Rs.30,000/- with interest and compensation and others.
We hold that the policies in question were started in March 2012 and there is no document in the record wherefrom it is evident that complainant can close the policy two years after commencing of the policies. Besides, complainant has prayed for refund of policy amount which is not permissible at all.
In view of the above discussions, we are of the view that o.p. has not made any deficiency towards the complainant since they have already returned Rs.40,000/- to the complainant in due time and as such, the case is rejected without cost.
Supply copy of this order to the complainant free of cost.
