ORDER BY HON’BLE PRESIDENT- MR. P.K. PADHI:
JUDGMENT
Complainants are practicing Advocates of Orissa High Court have filed the consumer complaint U/s.35 of Consumer Protection Act,2019 though E-Filing claiming Rs.5,50,000/- for self and Rs.1,00,00,000/- for Consumer Welfare Fund of Odisha.
Complainants being aggrieved by non supply of information under RTI Act for which they have paid fees of Rs.10/-.
Fees paid by complainant cannot be termed as consideration is the settled principles of law and there is provision of Appeal before 2nd Appellate Authority under RTI Act.
The complainants have also not explained as to how legal work hampered for non supply of RTI reply as a result of which the complainants have lost 5 lakhs and no proof of income of complainants have also been filed to assess the loss and thus we find that the consumer complaint is frivolous one and has no merit and accordingly the consumer complaint is dismissed. No cost.
