                                                          ORDER

JUSTICE SHRI.K.R.UDAYABHANU,PRESIDENT

The appellants are the opposite parties in CC.No.28/10 in the file of CDRF, Kannur.  The revision is filed over the order in IA.366/10 dismissing the application to set aside the commission report and to appoint a new commissioner.

          2. The Forum has dismissed the application pointing out that the  revision petitioner/opposite party  had not filed any work memo to the commission.

          3. In the circumstances, we find that it is only apt to direct the Forum to remit the commission report to the same commissioner directing him to note the points raised by the opposite party also.

          4. The revision petitioner is directed to file a work memo when the commissioner ask to re-inspect the premises and report on the points mentioned in the work memo.  The complainant may also be provided an opportunity to submit work memo.

          5. In the result, the order of the Forum is set aside.  The Forum will remit the CR to the same commissioner with directions as mentioned above.  The Forum will issue notice to the complainant also.   The matter stands posted before the Forum on 30.3.2011.

The office will forward the copy of this order to the Forum urgently.
