None is present on behalf of the appellant as well as on behalf of respondents.

On 21.09.2017, this appeal was adjourned with a note that in case if the appellant or respondents do not appear on the next date fixed, then an appropriate order would be passed in their absence.

Thereafter, on 01.11.2017, adjournment application has been filed by an advocate, who was not counsel in the present appeal. Therefore, application for adjournment was rejected.

However, on that date, one more opportunity was given to the appellant for argument in delay condonation application and the appeal was adjourned with a note that if the appellant does not appear on the next date fixed, an appropriate order would be passed in the absence of appellant.

We have perused the delay condonation application.  There is a delay of 10 months’ and 26 days’.  The delay has not been sufficiently explained in the application as well as in the affidavit, therefore, we are not satisfied with the delay occurred in filing the appeal.

Therefore, application for delay condonation is dismissed.  Consequently, the appeal is also dismissed.
