                                                O R D E R

 

NAWAB SINGH, J (ORAL)

 

          The instant appeal has been filed by Baderwal Projects Private Limited and Another-opposite parties (appellants) against the order dated February 20th, 2014 passed by District Consumer Disputes Redressal Forum (for short ‘District Forum’), Narnaul whereby complaint filed by Bijender Singh-complainant was allowed.  For ready reference, operative part of the order is reproduced as under:-

          “6.     Keeping in view the facts and circumstances of the case, we allow the complaint of the complainant and direct the opposite parties to allot the plot to the complainant and direct the opposite parties to allot the plot to the complainant and to issue allotment letter, within 45 days from the date of passing of this order, otherwise the opposite parties shall be liable to pay interest at the rate of 12% per annum on the booking amount of Rs.2,00,000/- from the date of passing of this order till allotment of plot to the complainant.  We also allow the cost to the complainant and against the opposite parties which are assessed at Rs.1500/-.”

 

2.      Learned counsel for the appellant assisted by Sh. Naveen Sharma, Manager Legal has stated that the appellants are ready to pay the amount of Rs.2,00,000/- alongwith interest at the rate of 12% per annum and Rs.1500/- cost imposed by the District Forum.  The amount shall be paid through demand draft before the District Forum on or before September 30th, 2015.

3.      In view of this, the appeal is rendered infructuous. 

4.      In case the aforesaid amount is disbursed by the appellants to the complainant before the District Forum on or before September 30th, 2015, the statutory amount of Rs.25,000/- deposited at the time of filing the appeal be refunded to the appellants on submitting the copy of the demand draft and against proper receipt and identification in accordance with rules.
