D/H absent.

Attendance on behalf  of the J/D filed  through his advocate. From perusal of the record it appears  that vide order dated 05.01.2023. D/H was  directed take steps for execution of the decree as per the provision  of order 21rule 30 CPC and furnishing the list of articles to be attached for auction for satisfaction of the decree but despite granting several opportunities the order dated 05.01.2023 has not been complied as yet and  D/H is absent today. From the perusal of record  it appears that the D/H is making pairbi in this case and appearing in a very casual manner and he was remained absent on 28.01.2023, 20.02.2023, 13.03.2023,  10.04.2023, 26.04.2023, 22.05.2023, 30.05.2023, 01.07.2023 and even today. It appears that in the present execuition case of the year 2014 D/H has lost interest in persuing this case. Hence, in view of above said facts the present execution is dismissed for non-prosecution by the D/H.
