ORDER
In brief, complainant’s case is that he is consumer of opposite party vide subscription voucher (SV 052) No.507698860, consumer No.47062 issued on 30.5.2009. As alleged on 3.11.2014, his gas copy was misplaced in the area of village Kherekan, Distt. Sirsa on which he got recorded DD No.30/MA, receipt No.30/20 on 4.11.2014 with Police Suvidha Kendra Distt. Sirsa. Thereafter, he approached to the opposite party for issuance of a new copy but op refused to do the same. Hence, this complaint.
2. On notice, opposite party appeared and contested the case. It is replied that connection of the complainant is non active since 19.7.2011 when the last cylinder was supplied. It is further replied that as per the policy of Government of India, all the gas consumers are required to submit KYC form alongwith copy of Aadhar card and bank details to regularize their connection but in this case the complainant had never submitted his KYC form and other documents. The connection is blocked since 19,7.2011. It is further replied that if the complainant furnishes KYV form alongwith Aadhar card and bank details, the connection can be got restored.
3. Thereafter, this case has been adjourned several times for evidence of complainant but complainant failed to adduce any evidence in support of his allegations despite of two last opportunities. The case was fixed on 10.11.2016 with last opportunity for complainant’s evidence but none appeared despite several calls and the case was adjourned for today for further proceedings. Today also none has appeared on behalf of complainant despite several calls.
4. This Forum is of the view that this case should be decided on merits on the basis of available record instead of dismissing the complaint in default of appearance.
5. We have heard learned counsel for opposite party and have perused the case file carefully.
6. The version of the opposite party cannot be disbelieved and in these circumstances, it is a simple case of submission of KYC form, copy of aadhar card and bank details by the complainant. Accordingly, opposite party is directed to restore the blocked gas connection of the complainant, if he furnishes KYC form alongwith copy of aadhar card and bank details as per the norms of company of opposite party i.e. Bharat Petroleum. With these observations, complaint stands disposed of accordingly no order as to costs. A copy of this order be supplied to the parties as per rules. File be consigned to the record room after due compliance.
