Learned counsel Sh. M.P. Singh for the appellant as well as learned counsel Sh. Sahil Gulati for respondent No. 1 has appeared.
Sh. Bheem Dutt Bhatt – respondent No. 1 in person has also appeared.
A compromise (paper No. 72) has already been submitted by both the parties, which is available on record.
The above compromise (paper No. 72) has been explained and read over both the parties, who after perusing and understanding the terms and conditions of the compromise has accepted the same.
As the compromise has been accepted by the respondent No. 1 – complainant as well as learned counsel for both the parties, hence the compromise is hereby accepted on record.
The appeal is decided in terms of compromise. The compromise shall form part of the decree. No order as to costs of the appeal.
Today an amount of Rs. 22,000/- has been paid by the appellant to respondent No. 1, who has appeared in person before the Commission. The suit in question has already been handed over to the appellant by the respondent No. 1.
It is contended on behalf of the appellant that the statutory amount deposited in the Commission be returned to the appellant.
As the matter has amicably and finally settled between the parties and the entire decretal amount has been paid, hence the statutory amount earlier deposited by the appellant at the time of filing of the appeal be returned to the appellant as per law.
File be consigned to the record room alongwith copy of this order.
A copy of this order alongwith copy of compromise be sent to the District Commission concerned for perusal and necessary information.
