1. Rajat Garg, complainant has preferred the present complaint against the opposite party (referred to as OP in short) on the ground that he is having a Airtel Digital TV/ Airtel DTH connection with OP vide account number 3021990651. On 23.05.2017 the complainant recharged the said Airtel Digital TV with Rs.1660/- only after getting a call from executive that there is a special offer in which after recharged of Rs.1660/- he will get the connection for 12 months under the scheme of six months plus six months. But the company disconnected the connection of the complainant on 14.11.2017. On enquiry, executive told that there was never such offer prevailed on your connection. Thus, alleging unfair trade practice on the part of OP, the complainant has sought following reliefs:-
i) OP be directed to give benefit of such offer,
ii) OP be directed to pay to the complainant a sum of Rs.15,000/- on account mental agony and harassment.
2. Notice was sent to the OP but none has appeared for the OP. As such OP was proceeded exparte.
3. The complainant has tendered documents Ex.C-1 alongwith annexure C-1/A and closed evidence.
4. The complainant has stated in his complaint that he recharged Airtel digital tv/ Airtel DTH account on 23.05.2017 for Rs.1660/-and OP gave him a special offer to get the connection for twelve months i.e. under the scheme of six months plus six months but OP disconnected the services on 14.11.2017. He further stated that on 15.11.2017 on asking of the complainant he was told by the OP that there was no such offer on his connection. To prove his case, the complainant has exhibited Ex.C-1 affidavit alongwith annexure C-1/A. In this document Annexure C-1/A he has produced recharge history that he has recharged the Airtel digital TV on 23.05.2017 at 5:41 PM but in this document no mobile number of the complainant and account number of Airtel digital Tv or Airtel DTH is mentioned. So, it cannot be said that the complainant has recharged the same. The complainant has not produced any other evidence to prove his case. The complainant has also failed to prove that OP has given him a special offer for recharge of Rs.1660/- under scheme six months plus six months. Although the OP is exparte but the complainant has failed to prove his case.
5. In view of the above discussion, we find no merit in the complaint and same is dismissed. A copy of the order be supplied to the parties free of charge. File be consigned to records in due course.
