This is a revision petition before this Court under Section 47(1) (b) of the Consumer Protection Act, 2019 against the impugned order passed by the learned District Consumer Commission-II, Lucknow by which the order passed by learned District Consumer Commission dated 15-10-2022 has been challenged.

The complaint case No. 81/2022 Mrs. Anupama Dwivedi and others V/s Bharti AXA Life Insurance Company Limited and others has been filed by the complainants/revisionists before the learned District Consumer Commission in the month of April, 2022 in which the proceedings have been started by the learned District Consumer Commision and on 23-06-2022 following order has been passed by the learned District Consumer Commission against the opposite parties exparte.

''पुकार करायी गयी। प्रतिवादी पक्ष की तरफ से पैरोकार उपस्थित। विपक्षी पक्ष अनुपस्थित। अन्तिम अवसर रहते हुए प्रतिवाद पत्र नहीं दिया गया। अत: अवसर समाप्‍त करते है। विपक्षी पक्ष के विरूद्ध एकपक्षीय कार्यवाही की जाती है। पत्रावली दि0 15.10.22 को वास्‍ते एकपक्षीय साक्ष्‍य परिवादी प्रस्‍तुत हो।''

The exparte order passed against the opposite party Insurance Company dated 23-06-2022  has been challenged by the opposite party before the learned District Consumer Commission by means of a recall application dated 23-06-2022 which is enclosed as Annexure-6 of the instant revision petition. The prayer in the said recall application is to recall the exparte order dated 23-06-2022 and to take the written statement on its

record. The said recall application has been allowed by the learned District Consumer Commission by the impugned order dated 15-10-2022 and the following order has been passed:-

‘’15-10-2022 :- पुकार करायी गयी। उभय पक्ष उपस्थित। विपक्षी पक्ष द्वारा दिनांकित आदेश 23-06-2022 को अपास्‍त करने हेतु प्रार्थना पत्र दिया गया। आपत्ति की गयी।

सुना गया।

पाया गया कि विगत तिथि दिनांक 23-06-2022 को विपक्षी की अनुपस्थिति में उसके विरूद्ध एक पक्षीय कार्यवाही की गयी। न्‍यायहित में पाया जाता है कि विपक्षी को एक अवसर देकर मामले का निस्‍तारण गुणदोष के आधार पर किया जावे। चूँकि विपक्षी असावधान रहा है जिससे मामले की कार्यवाही निलम्बित हुयी है और परिवादी पक्ष पीडि़त हुआ है। अत: उक्‍त प्रा0प0 हर्जे पर स्‍वीकृत होने योग्‍य है।

तदनुसार उक्‍त प्रार्थना पत्र 200/- हर्जे पर स्‍वीकृत। तदनुसार दिनांकित आदेश 23-06-2022 अपास्‍त किया जाता है।

प्रतिवाद पत्र विपक्षी ने दिया। पत्रावली पर रखा जावे।

पत्रावली दिनांक 26-12-2022 को वास्‍ते साक्ष्‍य परिवादी प्रस्‍तुत हो। ‘’

Perusal of the impugned order dated 15-10-2022 shows that the learned District Consumer Commission has recalled the exparte order dated 23-06-2022 by imposing the cost of Rs.200/- and the date has been fixed being 26-12-2022. In my opinion, the order dated 15-10-2022 passed by the learned District Consumer Commission is wholly justified and does not call for modification or interference.

In the result, the instant revision petition fails and is hereby dismissed. 

Let copy of this order be made available to the parties as per rules.
