heard by us.  The complainant had purchased a policy of insurance from the Ops. His grievance is that the terms and conditions of the policy were different from one agreed upon by him.   He had , therefore, sought the cancellation of the policy and the refund of the amount deposited by him.  Since, the OP has failed to oblige he has approached this forum with this complaint.

A perusal of the complaint shows that the complainant had received the policy documents which contained the stipulation that if the terms and conditions of the policy was not acceptable to him  he had the option of cancelling the policy within a period of 15 days from the receipt of the policy documents.  It is admitted by the complainant that he had not exercised the option within 15 days of the receipt of the policy documents  and has come up with the plea that the policy documents were received in his absence when he was away on official duty in Gujarat. We however are of the considered opinion that the option ha to be exercised within 15 days of the delivery of the documents to the complainant since the complainant had not exercised the said option within the said period , a binding contract had come into being which cannot b be avoided now we, therefore, hold that there are no grounds for admission of the complaint which is held to be non maintainable. File be consigned to record room.
