Heard. Smt. Manit Kaur filed this complaint under Section 12 of the Consumer Protection Act 1986 (herein-after called as ‘the Act’) against Bharti A X A General Insurance Company Ltd. Eminant Mall, 2^nd Floor Near Guru Nanak Mission Chownk Jalandhar and another (herein-after called as ‘Opposite Parties’) supported by various documents leveling allegations of deficiency of service on the part of the opposite parties.

Today, the case was at the stage of evidence of the complainant when both the parties amicably settled their dispute. Accordingly, the statements of the counsel for opposite party No. 1, complainant as well as her brother Dalbir Singh have been recorded. The opposite party No. 1 is ready to pay a sum of Rs. 1,00,000/- (Rs. One Lac only) as full and final settlement. It has also been stated that insurance company (opposite party No.1) is ready to make the payment within 30 days from today failing which the opposite party No. 1 would pay interest as determined by this Forum. The complainant in her separate statement is ready to accept Rs.1,00,000/- (Rs. One Lac only) as full and final settlement and has further stated that in case the insurance company (opposite party No. 1) failed to make the payment within 30 days from today then interest, so awarded by this Forum would be acceptable to her. She has stated that she is making the statement voluntarily. Her brother Dalbir Singh has also stated that her sister has made the statement voluntarily. In view of the statements of both the parties, this complaint is accepted. The opposite party No. 1 is directed to pay Rs. 1,00,000/- (Rs. One Lac only) to the complainant within 30 days from today failing which it will fetch interest at the rate of 9% per annum from the date of complaint till realization. The parties will remain bound by their respective statements. In view of above statements the present complaint is disposed off accordingly. Moreover, costs of Rs. 100/- imposed vide order dated 28.10.2015 by this Forum has not been deposited by the complainant. Copy of order be supplied to the parties as per rules. File be consigned to record room.
