          In this petition, challenge has been made to order dated 3.11.14 by which the complaint of the petitioner herein i.e. complainant before the District Forum has been dismissed in default.

          Ld. Counsel for the petitioner/complainant has submitted that due to wrong noting of the date before the District forum, the complainant as well as his Counsel could not appear on 3.11.14. 

There is an affidavit of the petitioner in support of explanation for non-appearance. There is no reason to believe the affidavit of the Petitioner/complainant.

          After some arguments respondents/OP has also not opposed the prayer of Petitioner/complainant.

In the interest of justice as well as for effective disposal of the case on merits, we set aside the impugned order dated 3.11.14 and restore the complaint to its original position.

The  petition stands disposed of accordingly.

          The parties shall appear before the District Forum on 10.9.2015.

The District Forum shall proceed further in the matter in accordance with the law.

          It is clarified that before proceeding further in the matter the District Forum shall serve the other respondents.

          A copy of this order as per the statutory requirements be forwarded to the parties free of charge and also to the concerned District Forum.

File be consigned to record room.
