COMPLAINT UNDER SECTION 35 OF THE CONSUMER PROTECTION ACT, 2019.

Present:-      Complainant in person.

                     Shri Sanjiv Pabbi, Advocate, Counsel for OP.

 

                     Today the case is fixed for filing evidence by the Complainant. At this stage, the Complainant has made a separate statement to the effect that he intends to withdraw the present complaint on some technical grounds seeking liberty to file it afresh.

                     On the other hand, Ld. Counsel for the OP opposed the prayer to the extent of filing it afresh on the ground that the Complainant is not entitled to fill up the lacuna at this stage.

                     Heard. The Complaint is at its initial stage. Admittedly the period of limitation is expiring on 10.05.2022. In our opinion, no prejudice is likely to be caused to OP in case the Complainant is permitted to file the complaint afresh. Hence, the Complainant is allowed to withdraw the present Complaint with liberty to file it afresh, if he so desires.

                     A copy of this order be sent to the complainant, free of costs and File be consigned to record room after due compliance.
