Complaint under Section 12 of Consumer Protection Act.

Present:     Shri Ram Lal, counsel for complainant.

                   OP ex-parte.

         

          Today the case was fixed for ex-parte evidence of complainant. No evidence on behalf of complainant is present. Learned counsel for complainant sought an adjournment. A careful perusal of the file reveals that on 26.11.2019, the OP was proceeded against ex-parte and case was listed for 09.01.2020 for ex-parte evidence of complainant. Thereafter, the complainant has already availed numerous opportunities for leading his ex-parte evidence but failed to conclude the same till today. More than one year has been passed in the same proceeding. It seems that the complainant is not interested in pursuing the present complaint. Hence, this Commission has left with no option but to dismiss the present complaint.

          Thus, in view of the above, the present complaint is dismissed being want of prosecution. However, complainant is at liberty to file fresh complaint before the appropriate Court/Commission. Parties concerned be communicated of the order accordingly and file be consigned to the record room.
