Following withdrawal of handsome amount from their saving bank accounts allegedly by some unauthorized persons using the cheque which was not issued by Bank consumer complaints were filed which was decreed by District Forum directing Bank to credit the sum in question to the account  holders.   In appeal  State  Commission  in  the  matter  of  stay  of operation of the impugned order directed petitioners to deposit half of the decreetal amount in addition to deposit already made by them.

 

The petitioners have come in revision against interim order passed by State Commission which has not yet gone into the merit of the case. Learned counsel for petitioners is apprehensive that in case the amount sought to be deposited by the petitioners is released, the petitioners who have chance for success, may loss deposits. While upholding order of the State Commission and dismissing revision petition, we direct that the amount sought to be deposited by the petitioners shall not be released without direction from this Commission. However, the amount earlier deposited by petitioners shall be

adjusted from the amount sought to be deposited by them. Petitioners are directed to make deposit of the amount in question within four weeks.
