Record is put up for order. 
Instant hearing arose out of a petition dt. 13/02/2013 filed by the o.p. challanging the maintainability of the case. 
We have gone through the petition dt. 13/02/2013 alongwith the written objection filed by the complainant together with entire materials on record and we find keeping an eye to the decision of the Hon’ble Supreme Court passed in General Manager, Telecom Vs. M. Krishnan and another - (2009) 8 Sec 481 adn judgement passed in RP no. 1703 of 2010 of the Hon’ble National Commission, this Forum is not in a position to entertain the matter.
In view of the above, the petition dt. 13/02/2013 filed by the o.p. is allowed on contest and instant case is not maintainable.
Thus, the complaint case stands disposed of accordingly.
